There were enough funds collected to file the opposition to the proposed water decree change by Independence Development.  Keep in mind the deadline for filing was January 31, 2020.


Franktown Citizens Coalition II has filed the Statement of Opposition with the Water Court.  The water court received fifty- (50) Statements of Opposition!  Our attorneys said they have never seen that many. The petitions with the many signatures were attached to our Statement of Opposition.  If you want to see the FCC II Statement of Opposition (or all of them), you can go to the water court's website.  We are located in Division 1.  The case number is 2019CW3220.

On Thursday, January 23rd, 2020, the Franktown Coalition (FCC II) will be holding a community meeting at the Franktown Fire Station from 6:00pm - 8:00pm.

The purpose of the meeting will be to discuss:

  • Explain the facts on the Independence "water grab" regarding the developer's filing in the State Water Court to amend the Upper Dawson portion of the current Independence water decree.
  • What is the legal process involved in opposing this in the State Water Court?
  • What are the options, both as a community and for individual home owners?
  • What will the cost be for each option? 

If, after the presentation and discussion, the community decides that they want to move forward and file an Opposition in the State Water Court against the developer's requested amendment, there will be a petition available at the meeting for signature.  This petition will be for the Opposition of the proposed amendment.

The following is an update on the planned development at the intersection of SH 83 and SH 86 (the 80 acres at this intersection) …

  • The development name is currently referred to as Arrowpoint.
  • The revised Arrowpoint plan has been preliminarly adopted by Douglas County with the below conditions (refer to the link below). 
  • It will have 40 acres of dedicated open space and 19 homes on the other 40 acres.  
  • This is the same area that has been considered for the large-scale development for many years and was the basis for the Save Franktown, now Franktown Coalition, efforts. Originally, the developer’s plan was for almost 250 homes on 62 acres. 
  • This revised and new plan now meets the zoning regulations based on the old      clustering methodology; which allowed "clustering" of homes; essentially a density bonus based on the amount of land that would be put into open space. Thus, giving the      developer three- (3) additional homes. Nineteen- (19) homes is much better than the previous proposal of over 250.  
  • Note: The regulations allowing clustering and more homes, if a density bonus is met based on the amount of open space in the plans, are not on the county books any longer, but the law requires that the county apply the law on the books at the time the proposal is submitted.
